§1 General principles

1.Definitions

a. The Event - The SwitzerLAN Event, in Bern, at BERNEXPO.
b. The Event Organiser / The Organiser - BERNEXPO, having its registered seat in BERNEXPO AG, Mingerstrasse 6, CH-3014 Bern, Schweiz.
c. User - Every person that uses the System to register for the Event.
d. Participant - Natural persons, who are 18 years old and have full capacity to perform acts in law. Persons below the age of 18 and a minimum age of 14 are obliged to fill in the parental approval form, filled out and signed by the legal parents.
e. Registration system, hereinafter referred to as the System - An Internet application, owned by MYI Entertainment, which enables the supporting of the registering process for Participants of the Event.
f. Participation fee - The amount determined by the Event Organiser that must be paid by Participants, so as to confirm their participation in the Event.

2.Additional provisions and information

a. The official Event website is: http://switzerlan.ch,
b. The scope of the System’s operation also includes a service that consists in the storing of User registrations in a database, and handling such registration, by the Organiser and/or Seller.
c. The technical requirements regarding the using of the System are not much different from the technical requirements concerning the using of the Internet. The User must have a computer with Internet access, as well as software that enables viewing of its contents. It is recommended to use the following browsers: Mozilla Firefox version 77.0 or higher.
d. The provisions contained in these Regulations constitute an integral part of applying for participation in the Event and are applicable to all Participants.

§2 Terms and conditions of participation:

  1. By registering, Participants accept these Regulations.
  2. To participate in the Event Participants must:
    a. Register for the Event, which can be done exclusively via an online form available at the Event’s website; and
    b. Pay the Event fee, as defined by the Organiser under Art. 5 hereunder,.
  3. The Organiser reserves a right to alter the Event date for reasons beyond its control. The Organiser shall not be responsible for covering any additional expenses of the Participants made in association with the Event.
  4. The Prticipation fee will not be refunded in any case.
  5. The number of Event places is limited. Participants will be enlisted on the first come first serve basis.
  6. Reselling tickets with a higher price is prohibited.

§3 Online Event registration

  1. Participants can only register for the Event via an on-line form available at the address [registration form address]
  2. The Event shall be open for registration from the start of ticket sales until the last available place has been booked.
  3. During their registration process, Participants must fill all fields marked (* ).
  4. Participants thereby guarantee that all the details filled in is correct.
  5. When the registration form has been filled in and the data confirmed the system sends a message to the email address provided in the form, thus confirming the registration.

§4 Event

  1. Tournament prizes will be given away at the award ceremony. If the winner is not present they forfeit their right to the prizes.
  2. The Event Organiser do not take any responsibility for the performance of artists and speakers or any other entertainment at the Herofest.
  3. The Event Organiser reserve the right to change the stage program without further notice.
  4. A Participant intending to bring a clan transparent or to set up roll-ups or similar installations has to announce this to the Event Organiser at least two weeks before the Event. The request must provide information about the size, appearance and number of installations. Based on this data, the Organiser will decide if the installations will be approved at the Event. Without a confirmation of the Event Organiser no installations may be installed.
  5. Operation of generally disturbing equipment, particularly speakers or subwoofers is prohibited. The operation of electrical equipment, with the exception of computers, including but not limited to toasters, kettles, refrigerators, coffee machines, etc. is prohibited.
  6. The Event Organiser are not liable to prosecution for the content of computers of the Participants. Each Participant is personally responsible for his data. The use and possession of unlicensed software is prohibited; the Swiss law is in action at the Event.
  7. Each Participant is responsible for the protection of his computer on the network against viruses, spyware, etc. It is recommended to have an up-to-date antivirus program and firewall installed.
  8. The Event Organiser assume no liability for any direct, indirect or consequential damage of any kind and cause (for example, thefts of any kind, defects in materials, or consequential damages in power failure).
  9. Participants and visitors are to have sufficient accident and liability insurance.
  10. Each Participant and visitor adheres to himself for damages caused at the location.
  11. Participants must behave decently.
  12. Verbal or written statements (for example on shirts or on transparents) which are vulgar, racist, sexist or discriminatory in other ways, are not allowed.
  13. Participants must follow the instructions of the Event Organiser, the Event crew and other authorities such as the police or security.
  14. Activities that are affecting the quality of the network and the Internet connection are not allowed.
  15. Spreading computerviruses, spyware, etc. is prohibited, even if they are spread unintentionally or against the better judgment of the Participant responsible.
  16. Hacking, the interception of login information etc. is prohibited.
  17. Outside of the location after 10 pm all Participants must remain silent.
  18. In the bedrooms, all Participants must remain silent.
  19. Participants are responsible that their seat and the area around it are clean. Participants must dispose of their waste independently in the marked container for PET, aluminum and glass.
  20. Alcohol is to be consumed according to common sense. For consumption and sale of alcohol the Swiss laws apply.
  21. Smoking inside of the buildings is prohibited.
  22. Any consumption of illegal drugs is prohibited.
  23. The Event Organiser have the right to adapt the seating plan in order to fill up the Event as efficient as possible. Reserving a seat does not grant the Participant the right to effectively receive the reserved seat.

§5 Permission to use image

  1. During the Event, the Organiser may arrange photo sessions and may film the Event for the purposes of broadcasting in the media (TV, radio, Internet, press) or for the purposes of documentation, marketing, or advertising for the Organiser or other parties named by the Organiser. By participating in the Event Participants give their implicit permission for the recording, use an/or dissemination by the Organiser, parties related to it of each Participant’s image, voice, expression in any promotional and marketing materials without limitation of time or territory.
  2. This permission means specifically that photo, video and audio recordings taken during he Event may be placed on the Event website or another website managed by the Organiser, as well as used in marketing materials, including by dissemination in audio or video formats. The Participants hereby weave any claims (existing or future), including for compensation from the Organiser for such use of their image, voice or expression for the purposes defined hereunder.

§6 Final provisions

  1. The Event Organiser shall act as the administrator of personal data of the Participants and Payers.
  2. The Event Organiser has entrusted, under a separate contract, the processing of personal data of the Participants and Payers to the Seller for the purposes of financial settlement of Event participation.
  3. Personal data of the Participant’s collected by the Event Organiser from the Event participation form shall be processed for the Event organisation purposes in accordance with the Regulations.
  4. Without their knowledge and consent, personal data of the Participant of the Event or the Payer shall not be transferred to any other data administrators.
  5. The disclosure of personal data shall be voluntary and the Participants and Payers have a right to access and modify their personal data.
  6. The Organiser reserves the right to use the email address specified when registering for the Event to make send notifications to Participants of the Event, including about changes in the Event programme or the Regulations.
  7. The Participants are required to observe the regulations document applicable at the venue of the Event, including especially principles of general safety, fire safety and security.
  8. During the Event, the Participants shall follow any housekeeping instructions that may be given by the Organiser and in particular shall refrain from recording of the keynote speech (in audio, video and photo formats, or any combination thereof).
  9. Should a Participant be found to be in breach of the Event Regulations, the Organiser shall have a right to refuse the Participant the right to participate in the Event and request him or her to leave the Event site or venue.
  10. The Event has a limited number of places for Participants. The Organiser reserves the right to reject registration requests when the limit is reached.
  11. The Organiser reserves the right to make changes in the Regulations. Upon an announcement by the Organiser of any changes to the Regulations, each Participant registered for the Event should immediately read such changes. Participants who do not accept any of the changes should notify of their position to the Organiser in writing via electronic channels at info@switzerlan.ch . The notification should reach the Organiser within 14 days from the entering into force of such changed Regulations in failure of which the Organiser shall regard the changed Regulations to have been fully accepted by the Participants.

  13. Any disputes arising in relation to the Event participation shall be decided by courts with jurisdiction for the Organiser.
  14. The Organisers shall not be liable whatsoever for the Participants’ property that may be lost, destroyed or stolen during the Event.
  15. The Participants shall be fully liable for any damage they cause both in the venues involved in any Event activities and in their accommodation.
